Former President Trump pulled out an unanimous victory at the Supreme Court on Monday in his historic ballot ban case that invoked the 14th Amendment, but a 5-4 division among the justices emerged beneath the surface — joined by one of his own nominees.
Conservative Justice Amy Coney Barrett and the court’s three liberals criticized their five conservative colleagues for going further than they needed to in resolving Trump’s case by also determining that the only way for the 14th Amendment to be enforced is through a statute by Congress.
“This suit was brought by Colorado voters under state law in state court. It does not require us to address the complicated question whether federal legislation is the exclusive vehicle through which Section 3 can be enforced,” Barrett, Trump’s last appointee to the high court, wrote in a concurring opinion. | |

In September of 2021, local Haitian-American leaders and members of Alliance San Diego asked me to join them in their trip to the Border Patrol’s Open Air Detention Site (OADS) in Del Rio, Texas. They asked because Texas authorities had begun enforcing federal immigration laws with a flare of old southern brutality, and aside from being a migrant rights activist, I knew both the Border Patrol as a former agent and the ways of southern cops and sundown towns as I grew up in Alabama. My role would be limited to providing them with guidance regarding the Border Patrol’s culture and protocols and any safety issues that might arise from their operations. | |

Since Aaron Bushnell’s death by self-immolation this week in protest of Israel’s genocide in Gaza, his detractors have warned about the risk of “contagion,” suggesting that his protest will encourage imitators (who, they imply, share his alleged mental instability). There may or may not be additional self-immolators before the slaughter comes to an end, just as Bushnell was preceded by a woman, yet to be identified publicly, who burned herself to death outside the Israeli consulate in Atlanta in December. But the purpose of lighting yourself on fire is not to encourage other people to light themselves on fire. It is to scream to the world that you could find no alternative, and in that respect it is a challenge to the rest of us to prove with our own freedom that there are other ways to meaningfully resist a society whose cruelty has become intolerable. | |
